Providing a Satisfying Process:

 

In the midst of a lawsuit, mediation offers a wise alternative dispute resolution vehicle.  It allows the parties to use the positive formalties of the adversarial legal process but gives them an opportunity to craft their own result in their own way, rather than leaving it to a judge or jury.  

 

When mediating litigated cases, I start from the proposition that attorneys and parties are the experts and hold the keys to their own success.  The mediator's role is not to tell participants what to do but to effectively navigate them through their negotiation process.  This work includes familiarity with applicable laws, rules of evidence, and financial issues, but more importantly, it involves competence in orchestrating the discussions necessary to maximize the possibility of a party-driven resolution.  


Skillful Diligence:

 

A satisfying process includes trusting the mediator's ability and integrity.  In my work as a mediator, I incorporate the following skills as needed: 

  • Encouraging constructive debate among the parties to the dispute without giving away requested confidences;
  • Participating in private intra-party dialogue between attorneys and their clients to explore assumptions, perceptions, strengths and weakness;
  • Clarifying interests, needs, and concerns by asking appropriate questions;
  • Handling difficult people and intense situations with diplomacy and tact;
  • Exploring creative options for meeting the parties' needs and interests;
  • Facilitating dialogue that can improve the working relationships among disputants;
  • Orchestrating a win-win situation.
